¶ 1  THE COURT:  Having heard all of the submissions, including the fact that the Crown may well have been aware, before she proceeded by summary conviction today, that she might better have proceeded by indictment, given the date — alleged date of the entry of this individual, I agree with defence counsel's submissions in respect to how this matter proceeded and that the offence itself took place on a specific date, which is not within the six months of the laying of this information, and the charge is dismissed.
