The Queen v. S.M.
Ontario Court of Justice, Toronto
Judge H. McArthur
(withdrawn: 29 June 2012)

Crown:  A. Stanford, Assistant Crown Attorney, Toronto
Defence:  Craig Penney, Indecent Act and Voyeurism Lawyer, Toronto

¶ 1   CROWN:  Just for the record, it's Stanford, S-T-A-N-F-O-R-D, initial A., appearing for the Crown on this matter. Your Honour, this is a matter that has been extensively pre-tried by my office. Ms. Pirraglia has been involved in it. Your Honour would see, if you look at the Information, that there are two days set for trial in September on this matter.

¶ 2   Mr Penney and I have spoken about it. There are significant issues with respect to I.D. on this matter. We are also taking into account the nature of the charges that are before the Court, the fact that the accused comes before the Court with no criminal record, and the length of time that has been set for trial, and we have determined that, due in no small part to the I.D. issues, but also to other factors, it is not in the public interest to proceed with these charges. I'm going to ask that they be marked withdrawn.

¶ 3   THE COURT:   All right, then. If the charges could be withdrawn.
