¶ 1  PROSECUTOR:  Yes, there was a judicial pretrial held with my colleague, Mr. Jay Cox, and, as a result of that pre-trial, Mr. Cox is of the conclusion that this matter should be withdrawn. I just — let me explain.

¶ 2  THE COURT:  Mmm hmm.

¶ 3  PROSECUTOR:  There were outstanding disclosure issues. Mr. Cox has not been able to resolve those issues and therefore he has instructed me to withdraw the charge.

¶ 4  THE COURT:  All right, Mr. Penney, for the reasons stated by the prosecution, the charge is withdrawn.

¶ 5  MR PENNEY:  Thank you, Your Worship.

¶ 6  THE COURT:  Okay, thank you, sir.
